What is the automatic stay?

Upon the filing of your Chapter 7  or 13 Bankruptcy, an automatic stay goes into place which means that most creditors are prohibited from taking any action to collect a debt that you owe. If a creditor tries to collect a debt in violation of the automatic stay then the court could hold that creditor in contempt for violating the automatic stay and award the debtor money sanctions. There are a few exceptions to this rule where the creditor does not need to seek court permission:

  1. If your landlord has already received an order to evict you, then your landlord can continue the eviction process.
  2. Criminal cases can proceed.
  3. Case to establish paternity.
  4. Case to collect and/or modify child support or alimony.
  5. Tax audits.
